There are many steps to obtaining the right family visa

The first step requires that U.S. Citizenship and Immigration Service (USCIS) approve an I-130 Petition for Alien Relative for you. The relative who acts as your sponsor must have current legal status in the United States. The petition must include proof of the relationship.

Next, the U.S. Department of State must assign an immigrant visa number to your petition. Immigrant visa numbers are not always immediately available. The Visa Bulletin, posted by the Department of State, provides updated information about the availability of immigrant visa numbers.

After being assigned a visa number, you may apply for the status of lawful permanent resident. If you are not in the United States when you are assigned a visa number, you must complete the application process at a local U.S. Consulate office.

Who may sponsor an immigrant for a family visa?

To be considered eligible to sponsor somebody for a family visa, you must meet the following requirements:

  • You must show proof that you are a legal relative of the person you are sponsoring.
  • You must be an American citizen or a lawful resident of the U.S.
  • You must be able to prove that you can support your relative at more than 125% of the U.S. poverty level

Whom can you sponsor?

  • Spouse
  • Your minor-age, unmarried child if you are under age 21
  • Your child of any age, whether married or unmarried, if you are over 21
  • Sibling, if you are adult age
  • Parent, if you are adult age
